Rules for buying on Open3D: catalog parts, custom uploads, consumer rights, and how we protect both you and the service.
The Open3D shop and service (open3d.pt) are operated by OpenCloud (“we”, “us”). Contact: hello@open3d.pt. Open3D is an OpenCloud brand for 3D printing, catalog parts, and custom jobs.
By creating an account, placing an order (including via API/MCP/AI agent), uploading files, or using the site, you accept these Terms and the Privacy Policy. If you disagree, do not use the service.
We mainly sell to end consumers (B2C) in the EU, without prejudice to business sales. Mandatory consumer rights under Portuguese and EU law (including Decree-Law 24/2014 and consumer goods guarantee rules) prevail over any conflicting clause. Limitation clauses apply only to the extent allowed; they do not waive non-waivable rights.
The catalog includes (a) Open3D Studio own-brand pieces and (b) partner/third-party designs. Partner pieces are manufactured by us under licence or agreement; original design responsibility remains with the designer, except where mandatory law says otherwise. Prices and availability may change until the order is confirmed.
When you upload a file (STL, OBJ, 3MF or other) or order a custom print: • You alone are responsible for the file content, legality, and suitability for your intended use. • You warrant you hold all required IP rights (or a valid licence) to ask us to print/reproduce it, and that it does not infringe third-party rights. • You agree to indemnify and hold OpenCloud/Open3D harmless from third-party IP claims related to your file or the printed object made at your request. • We act as a manufacturing/print service for the model you provide — not as designer or certifier of the finished product.
You must not order or upload models for firearms or regulated components, explosives, illegal devices, counterfeiting, unlawful content, or any illegal purpose. We may refuse or cancel such orders without refund where the law allows. 3D-printed parts are generally decorative or general-purpose and uncertified. Unless we state otherwise in writing, they are NOT suitable or certified for medical/implant use, aviation, structural automotive, personal safety, critical load-bearing, high temperature/pressure, or regulatory conformity (CE/UKCA/FDA/etc.). Risky use is solely at your risk.
Instant file quotes are automated estimates (volume, material, finish, shipping). They may be revised before production if geometry, supports, mesh issues or real requirements differ. The purchase contract forms when we accept the order and payment (or payment authorisation). Obvious pricing errors may be corrected with cancellation and refund.
3D printing involves natural variation: layer lines, slight warping, batch colour differences, support marks and finish. Dimensions are approximate. “Raw” parts are not polished. These traits are not defects unless they substantially depart from what was reasonably described or agreed in writing.
Production and delivery times are estimates (business days). Carrier delays, force majeure, filament/resin shortages or technical file review may change dates. Risk of loss/damage in transit follows applicable consumer law; for professionals, upon handover to the carrier unless agreed otherwise.
If you are a consumer buying standard catalog goods at a distance, you may have a 14-day right of withdrawal under DL 24/2014, subject to legal return conditions. IMPORTANT EXCEPTION: the right of withdrawal does NOT apply to goods made to the consumer’s specifications or clearly personalised (Art. 17(1)(c) DL 24/2014). Prints from your file, made-to-order sizes/colours, or other custom work are generally excluded. You may cancel before production starts; after production starts, only a partial refund at our discretion or where the law requires.
Consumers benefit from the legal conformity guarantee. For lack of conformity, email hello@open3d.pt with photos, order id and description. For custom parts from your file, conformity is assessed against the file and options you chose (material/finish), not against undisclosed uses or engineering requirements we did not contract for.
To the fullest extent permitted by law — without prejudice to mandatory consumer rights, wilful misconduct or gross negligence — our aggregate liability per order is limited to the amount paid for that order. We are not liable for lost profits, your failure to keep file backups, indirect damages, or unsuitable use of parts. Nothing excludes liability that cannot lawfully be excluded.
You are responsible for account credentials and for AI agents or integrations acting on your behalf via API/MCP. Agent-placed orders bind you as if you placed them. Keep API keys secret. We may suspend abuse, fraud or breaches.
Open3D brand, logo, site, photos and Open3D Studio designs are ours (or licensed). Buying a physical object for personal use does not grant IP rights to redistribute our manufacturing files.
Portuguese law. EU consumers also keep mandatory protections of their habitual residence. Disputes: competent courts under consumer-protection rules; you may use the EU ODR platform. Professionals: courts of OpenCloud’s seat, unless mandatory rules say otherwise.
